<p>Vehicle searches constitute one of the most sensitive investigative measures in criminal procedure because they serve an important evidentiary function while simultaneously interfering with privacy, property, personal liberty, and the protected sphere of individuals. This study examines the legal regulation of vehicle searches in the legal systems of Iraq and Kuwait through a comparative analytical approach. It focuses on the legal foundations governing vehicle searches, the competent authorities entitled to order or conduct them, the conditions required for their validity, the circumstances permitting searches without prior authorization, and the permissible scope of inspection and seizure. Particular attention is given to the relationship between the legality of a vehicle search and the evidentiary value of materials obtained through it. The study also analyzes the consequences of unlawful vehicle searches, including procedural nullity, exclusion or loss of evidentiary value, challenges before judicial authorities, and the potential criminal or disciplinary liability of officials who exceed the limits of their legal powers. The comparison demonstrates that Iraqi and Kuwaiti law share a common commitment to the principle of legality and to balancing investigative necessity with the protection of individual rights. Both systems recognize that vehicle searches must be based on lawful authority and must remain connected to a legitimate investigative purpose. However, differences emerge in the treatment of procedural defects, the classification and scope of nullity, and the judicial consequences attached to illegally obtained evidence. The study concludes that both legal systems would benefit from clearer and more explicit statutory regulation specifically addressing vehicle searches, including rules on consent, flagrante delicto, scope of inspection, incidental discovery, digital evidence, documentation, and the legal effects of procedural violations. Greater clarity would strengthen both the protection of individual rights and the reliability of criminal evidence.</p>
